Stealing Someone Else’s Story
If you ever
· see or read a story written by someone else,
· copy part or all of it,
· put your name on it as the author,
· and try to post or publish it on a web site,
that is called stealing.

The actual term is Plagiarism. In the adult world of business, there are serious legal ramifications for actions involving Plagiarism. So are grade schools, high schools and colleges.

Over the last month or so, about half a dozen stories posted on SIYE have been reported to be stolen, usually from other Harry Potter FanFiction sites. Enthusiastic readers have read them and notified SIYE staff members.

SIYE takes any report of plagiarism very seriously and will investigate any allegations to the best of our abilities. We will also help and assist any other FanFiction website investigating a case of plagiarism involving SIYE. In the cases found at SIYE, all were determined plagiarized and appropriate action was taken. The stories have been removed and the offending author’s account seized.

For those plagiarizing authors who think they can be anonymous on the Internet, turn off your computer, and sleep well at night, think again! SIYE’s technical staff are professional adults who maintain servers, networks, and websites for a living. And they are very good at what they do. There are ways and methods of finding who you are. You might get away with it at another website, but at SIYE, you probably won’t.

So, the sign is out and you have been warned.

I've had it happen to two of my stories, one very recently, and let me say that it does not make authors very happy. Why someone would do that to begin with, I have no idea. It was suggested that because Harry had been so OC that it might have originally been a Draco/ Ginny story. I did a bit of research and found it elsewhere. Sure enough, it was. Eeeew! No wonder Harry was such a @#&$! I’m going to be harsh which I usually refrain from being. How sad and pathetic are you to steal a story online and repost it? Wow, I did a great job passing that story off as my own! Or does your immature little mind start to think of the story as your own, that the praise is for something you created and that you deserve? It’s absolutely laughable in this scenario. Equally silly, I actually found someone who plagiarized one of my reviews on this site. Yes, like the author would fail to notice that the other reviewer posted the exact same paragraph that I had several hours earlier. Again, what’s the point? What did that person gain? Regardless of the situation, however, plagiarism is always wrong wrong wrong. Kudos to Sir Ollivander and all staff who are taking such an aggressive stand and will work with other sites to nail people who do this. Oh, and very nice Yunchao. Yes, Jo said it best.

IP trace has little to do with it. Very little. I wont disclose my tricks or what happens, but be assured that internet acces to those who break this rule is limited for a short period of time, and they never see another hgnetwork site again. So I could apply the same formula to authors at SIYE and other fanfiction sites, right? As long as I give them credit, I can use their ideas, right? Or do I also have to ask for permission first? If that's the case, shouldn't we ask Jo for her permission?

That made me giggle. You are well aware that JK has given permission to use her works in the form of fiction. Many sites SIYE included offer the disclaimer because she is a published professional author. You don't need to have a disclaimer, its just common practice.

Leaving out your sarcasm, it is NOT ok to rip off another fan fiction story and claim it as your own.
When a fiction author writes a story it is theirs, however you well know they cant claim it as their own work if they use copy written material such as JKR's characters. Its a fine line we walk, and if at any moment she decides fiction isn't allowed the stories and sites will disappear.

There will be a few fic sites, but most of the larger ones will close because no one wants to fight the lawyers. As for asking permission from another author, and posting doubtful that will happen as many authors do not willingly give up their work. Posting a story with a disclaimer that the fiction isn't yours and you borrowed it, will get you removed. :-) Regards

Altough Simenco it's not too easy too write things that don't look like someone else's, since most of the possible plots have been covered, one way, or another. Okay, boys & girls, I beg you not to make fun of me for being a lawyer, but I'm going to do some clarifying here because of nascient confusion I see arising. There are two separate issues here. One of these is plagiarism, the other is copyright infringement. They are completely different issues, although they often overlap. Plagiarism does not involve stealing; it involves lying. That is, when you present someone else's work as your own, you are lying to the reader. This is true even if you have the owner's permission to use it. The sin of plagiarism is in misleading your reader. If it's done for profit or some other benefit (e.g., a grade in school) it's the crime of fraud. Copyright infringement, on the other hand, is a form of stealing beause it is using someone else's property without their permission. It does not matter whether you attribute the work to the author or not (i.e., whether you plagiarize or not) because you've still used the work without permission. There are both civil remedies and criminal penalties associated with copyright infringement. I illustrate with the following example: Torak writes a story. I want to use that story elsewhere: 1. If I use the story without Torak's permission, and put my name on it as if I'd written it, I've committed both plagiarism and copyright infringement. 2. If I get Torak's permission to use the story, but put my name on it as if I'd written it, I have committed plagiarism but not copyright infringement. 3. If I use the story without Torak's permission, but properly attribute it to Torak rather than to myself, then I have committed copyright infringement but not plagiarism. 4. As another author who has been the victim of blatant plagiarism, I also would like to thank the staff of SIYE for taking a hard stand on this issue. As little as a few weeks ago I had my first fic, Home Alone, completely copied right down to my disclaimer and promise for a sequel, Shadow of the Serpent. I don't surf the sites as often as I used to, so I would have missed it if a faithful reader hadn't brought it to my attention. (Just so you know, it was published on another website, not SIYE, but the lovely person who brought it to my attention was a SIYE reader.) This is the second time to my knowledge I have been plagiarized. The other instance was caught by the admin of a site I don't publish on but had happened to have read my work elsewhere. I still don't know why people would bother... I mean, how much effort does it take to copy and paste? Any reviews a plagiarizer gets are not based off his or her own work, right? In my case the person didn't even bother to try and hide the fact that she hadn't written it... she just deleted my name. She even used my author's notes! I notified the admin of the site and reported it, and it was taken down very quickly. However, not before I submitted my own review to the pseudo-author, who was obviously a young person with some issues, informing her that she had been busted. Anyway... rant over. Bottom line is that I appreciate SIYE watching out for us, and that goes for both the staff and readers here. Thank you!

The best rule is, when in doubt, then don't use it. Just go by that and you'll be safe. There are still enough original ideas out there that you shouldn't have to use someone else's.
